E-Kad Terms of Use

These terms cover E-Kad, the digital wedding card service at ekad.akad.com.my, operated by Akad. They are an agreement between Akad and the person who builds and publishes a card. Guests who open a card are not party to these terms, though the sections on guest information and guest content explain how their details are handled. Akad's Privacy Policy at akad.com.my explains how we handle personal information and forms part of these terms.
1. Accepting these terms
By building, paying for, or publishing an E-Kad card you accept these terms. If you do not accept them, please do not use the service. We may update these terms from time to time. The effective date above shows when the current version took effect, and continuing to use E-Kad after a change means you accept the updated version.
2. Your account
E-Kad uses your Akad account. The same sign-in works across the Akad app and E-Kad, and your wedding details are shared between them. You are responsible for keeping your sign-in secure and for everything done through your account. If you invite a partner or a collaborator to your wedding, they can see and edit the same card and the same guest information you can, so invite only people you trust with both.
3. What you are buying
E-Kad is a one-time purchase of RM99 for one wedding card. There are no tiers and no subscription. Building and previewing your card costs nothing. What the payment unlocks is publishing: the moment it succeeds, your card can go live and be opened by your guests. The price shown at checkout is the price you pay. We may change the price for future purchases, and that never changes what you have already paid.

- Payment is taken on the checkout page of our payment gateway, HitPay. Akad never sees or stores your card number.
4. Promotional codes
We sometimes issue codes that unlock a card without payment or at a reduced price. A code is a personal offer rather than something you own. Codes may not be sold, resold, or transferred, they may expire or be withdrawn, and we may void a code and the card it unlocked if it was obtained or used in a way it was not intended for. A code has no cash value and cannot be exchanged for money.
5. Refunds
Payment unlocks publication of your card. Because the card is delivered to you the moment it goes live, the purchase is non-refundable once your card is published. If you have paid but have not yet published, write to support@akad.com.my and we will refund the payment in full. Nothing in this section affects any right you have under Malaysian law that cannot be excluded.
6. Your published card
A published card lives at its own web address, and anyone holding that address together with your invite code can open it. The invite code keeps your card from being stumbled upon. It is not a password unique to each guest, so anyone you send it to is able to pass it on. Treat whatever you put on your card as something you are comfortable sharing with everyone you invite, and with anyone they might forward it to.
- Your published card stays available for at least 12 months from the date of purchase. After that we may retire it, and we will give you reasonable notice before we do.
- You can ask us to take your card down at any time, and we will.
7. Your content
Everything you put on your card stays yours: your names, your photographs, your words. You give Akad permission to store, reproduce and display that content for the purpose of running E-Kad, showing your card to your guests, and keeping backups. That permission ends when your card is removed, apart from backups we hold for a limited period afterwards. You confirm that you have the right to use everything you upload, including photographs taken by a photographer and any music you add to your card. If you do not hold those rights, please do not upload it.
8. Your guests and their information
Your card collects information from your guests: their names, their phone numbers where they leave one, how many people they are bringing, and the wishes they write. That information is collected for you, not for us. You choose what to ask, you choose who to send the card to, and you decide what happens with what comes back. Akad stores and processes it on your behalf so that the RSVP, guestbook and gift features work. In the language of Malaysia's Personal Data Protection Act 2010, you are the data user for your guest list and we process it under your instructions.
- You need a lawful basis for holding your guests' details, and you should be ready to tell a guest why you have them.
- Use them for your wedding, and for nothing your guests would not expect. An invitation is not permission to market to someone.
- Do not pass your guest list to anyone else, including vendors, without your guests' knowledge.
- If a guest asks you to correct or delete their details, honour it. Write to us and we will help you do it.
9. Guest content and moderation
Guests can leave wishes on your card. Wishes that our automatic checks flag are held out of sight until you have reviewed them, and you can hide any wish yourself at any time. Once you have had a fair chance to review it, you are responsible for the guest content that stays visible on your card. Separately, we may remove content from a card, or take a card offline, where we have good reason to believe it is unlawful, infringes someone's rights, or is being used to harass a person. We will tell you when we do that, unless the law prevents us from doing so.
10. Gifts and salam kaut
If you turn on the gift sections, the bank details or QR code you enter are shown to every guest who opens your card. Please check them carefully, because we display exactly what you enter and we cannot recover money sent to the wrong account. Money sent by a guest travels directly from that guest to you. Akad is not a party to it, does not hold it, does not process it, and takes no commission from it. Any question or dispute about a gift is between you and your guest. Gift sections close automatically 60 days after your wedding date.
11. Acceptable use
E-Kad is for your own wedding. Please do not use it to impersonate anyone, to publish content that is unlawful, hateful, obscene or infringing, to gather information from people under false pretences, or to attack, probe, or overload the service. Do not resell access to E-Kad, and do not attempt to publish cards without paying for them.
12. Availability and liability
We work hard to keep E-Kad running, and especially around the dates that matter to you, but we cannot promise it will always be uninterrupted or error-free. E-Kad is provided as is. To the fullest extent Malaysian law allows, Akad's total liability to you in connection with E-Kad is limited to the amount you paid for your card, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Please keep your own copy of anything you would be sorry to lose.
13. Changes to the service
E-Kad will keep changing. We add sections, retire designs, and improve how cards work. We may change or discontinue features, and where a change would materially reduce what you have already paid for, we will give you reasonable notice first.
14. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising out of or in connection with them.
